You may evaluate our solutions for as long is required; if your evaluation license expires and you need more time to continue your evaluation then just let us know and we will happily extend the evaluation license.

You MUST purchase the appropriate Product/User Licenses before using any CaoSys software in a production/live environment.

CAOSYS SOFTWARE LICENSE AGREEMENT & TERMS OF SALE (May 2008 Rev:1.6) IF YOU DOWNLOAD ANY OF OUR SOFTWARE AND/OR PURCHASE USER BASED LICENSES THEN THE FOLLOWING TERMS APPLY. THIS LICENSE AGREEMENT/TERMS OF SALE SUPERCEDES ALL OTHER CAOSYS/APPLTOP LICENSE AGREEMENTS/TERMS OF SALE. CAOSYS (“Licensor”, “CaoSys”) GRANTS THE CUSTOMER (“Licensee”, “Customer”) A LICENSE TO USE THE SOFTWARE AND DOCUMENTATION (“Software”) AS INDICATED BELOW. LICENSE: Licensee shall have the right to use the software only in the operating environment identified by Licensor. Licensee may use the Software solely for its own internal data processing operations unless otherwise arranged with Licensor. Licensee may make a single copy of any media CD for backup purposes only. Additional copies may be requested directly from Licensor. Licensee shall not remove any product identification marks, copyright notices, trademarks or any other kind of notice from the product or its documentation without prior written consent from Licensor. Licensee shall not transfer, sell, assign or lease the software to any other party. COPYRIGHT/OWNERSHIP OF SOFTWARE: Licensor is the sole and exclusive owner of the Software. International copyright and other intellectual property laws protect all Software and associated materials. Licensee acquires only the right to use the software. FEES: Product usage and support fees are payable in the form of User Based Licensing. You MUST purchase a License before using any CaoSys software in a production/live environment. You are free to use the software in a non-production/non-live environment for evaluation purposes only for as long as is required. All prices for products and services are subject to change without notice. PAYMENT: Payment is due 30 days from date of purchase. Methods of payment are available including BACS and cheque. REFUNDS/CANCELLATIONS All of our software solutions are available for evaluation purposes prior to purchase; therefore all license purchases are final and refunds are not available. DELIVERY All software and documentation is delivered digitally via our website at www.caosys.com. LIMITED WARRANTY: With an active Support Agreement, full support services will be provided for the term of the Agreement. Please refer to the support guide and support schedule for further information. VERIFICATION: At Licensor’s written request, the Licensee shall provide Licensor with a signed statement that the license is being fully adhered too in every way all of the time. DISCLAIMER OF DAMAGES: In no event will Licensor be liable to the Licensee for any special, consequential, direct, indirect or similar damages including any lost profits or lost data arising out of the use or inability to use this software. This disclaimer applies regardless of whether you accept the software. HIGH RISK ACTIVITIES: The Software is not fault-tolerant and is not designed, manufactured or intended for use in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of the Software could lead directly to death, personal injury, or severe physical or environmental damage ("High Risk Activities"). Accordingly, Licensor and its suppliers specifically disclaim any express or implied warranty of fitness for High Risk Activities. Licensee agrees that Licensor and its suppliers will not be liable for any claims or damages arising from the use of the Product in such applications. GENERAL: International law will govern this Agreement. This Agreement may only be modified by a license addendum that accompanies this license or by a written document that has been signed by Licensor.
